Todas as pessoas que entram em contato com ICE ou o Tribunal de Imigração nos Estados Unidos têm direito a advogado. Porém, a contratação de um advogado não é obrigatória nestes processos. Todos os imigrantes têm o direito de se defenderem sem constituirem advogado para a defesa.
